Success In Complex Joint Venture Litigation

Ian Matthews and Jonathan Lisus, for Mattamy Homes, were recently successful in a complex proceeding involving the ownership and alleged breach of obligations under a joint venture agreement. Justice Myers of the Ontario Superior Court of Justice accepted Mattamy’s argument that it ought to be permitted to pursue one of the key participants in negotiations surrounding the joint venture in tort for inducing breach of contract, rejecting that party’s attempt to extricate himself from the underlying $400 million litigation by seeking partial summary judgment.
