Zain’s practice covers all aspects of business litigation including contract and shareholder disputes, director and officer liability, enforcement of indemnities and guarantees, administrative and regulatory matters, negligence and tort claims, arbitrations, appeals, and injunctions. He is a consummate problem-solver and prides himself on giving practical, results-oriented advice and representation.
Zain’s track record includes high-profile appeals and multi-week commercial trials and hearings. He has obtained significant judgments for clients in precedent-setting cases, appearing at all levels of court in Ontario, the Federal Court, the Competition Tribunal, and the Supreme Court of Canada.
In addition to commercial disputes, Zain has an extensive public law practice. He has advised local and regional municipalities, aboriginal groups, individuals, Crown corporations, and other corporate clients in administrative and constitutional litigation across a wide range of industries and regulatory regimes. He has developed considerable expertise in judicial review proceedings before the Divisional Court, obtaining extraordinary remedies against public authorities.
Zain also maintains an active pro-bono practice and has represented public interest organizations, including the Canadian Civil Liberties Association. For several years, he coached Osgoode Hall Law School’s Laskin Moot team.
Zain has been consistently recognized by his peers in the Canadian Legal Lexpert Directory and The Best Lawyers in Canada “Ones to Watch”. He is a co-author of the Chambers Global Practice Guide for Litigation in Canada. In 2023, Zain was appointed a member of the Civil Rules Review Working Group launched by the Chief Justice of the Ontario Superior Court of Justice and the Attorney General of Ontario to propose reforms to the province’s civil justice system.
Prior to joining the firm, Zain clerked for the Honourable Justice Michael Moldaver at the Supreme Court of Canada and worked at a leading New York firm on class actions and regulatory investigations.
