LOLG Successfully Resists Motion at the Divisional Court

On November 17, 2020, Michael Currie successfully resisted a motion seeking an extension of time to file an appeal to the Divisional Court. The plaintiffs sought to appeal a lower court decision that stayed their action in favour of arbitration under section 7 of the Arbitration Act, 1991. LOLG argued the appeal lacked merit because section 7(6) of the Arbitration Act precludes appeals. The Court accepted this argument, dismissed the motion, and awarded costs against the plaintiffs.
