Court Awards Substantial Indemnity Costs For Failed Mareva Injunction

On June 29, 2016, the Ontario Superior Court of Justice (Commercial List) awarded substantial indemnity costs against parties seeking a Mareva injunction. The Court held that the moving parties made unsuccessful allegations of breach of trust and fraud and failed to make full and fair disclosure in their motion material.
