The British Columbia Court of Appeal upheld a trial judgment dismissing a $17 million claim for a breach of credit agreement.  On February 22, 2016, the British Columbia Court of Appeal released its decision upholding the BC Supreme Court’s trial judgment dismissing Maxam Opportunities’ claims for $17 million for breach of a $30 million credit agreement. The trial judgment considered and applied the law of implied terms, entire agreement clauses and contractual interpretation.
