Arbitral Award Upheld By Superior Court On Appeal

On December 20, 2016, Madam Justice Kristjanson of the Ontario Superior Court of Justice released Reasons dismissing an appeal from an arbitral award in which a claim for rectification of a right of first offer in a unanimous shareholders’ agreement was dismissed. The award contains an extensive review of the law governing rectification claims and the appeal decision is a helpful review of principles governing appellate review of arbitral awards.
