On December 28, 2016, Regional Senior Justice Heeney of the Ontario Superior Court released reasons in an urgent application seeking the release and discharge of an easement held by the Windsor International Airport over adjacent lands. The successful applicant, the former owner of the adjacent lands, argued that the Airport’s easement, relating to an approach runway lighting system, had been abandoned and was no longer of any use. The reasons contain a helpful review of the law respecting abandonment of easements and can be found here: huszti-holdings-inc-v-your-quick-gateway-reasons-for-judgment-dece. The applicant was represented by Shaun Laubman and Niklas Holmberg.
