Terry O’Sullivan, Paul Michell and James Renihan, have been granted leave by the Supreme Court of Canada on behalf of the Council of Canadian Administrative Tribunals to intervene and make oral argument in the Vavilov/Bell Canada/NFL appeals which will be heard on December 4-6, 2018. These appeals will involve a full review of the level of deference to be accorded to administrative tribunals and is intended to represent a revisiting of the “Dunsmuir” test. As such, it is without doubt the most important administrative law case the Supreme Court has heard in some time.
