Supreme Court Dismisses Leave Application

Jonathan Lisus and Philip Underwood successfully resisted an application for leave to appeal to the Supreme Court of Canada of an appeal they won in the Ontario Court of Appeal dealing with the extraterritorial application of Ontario’s Regulated Health Professions legislation. The applicants sought to challenge the Court of Appeal’s finding that Ontario’s regulatory scheme does not prohibit the online sale of prescription eyewear by a British Columbia company to Ontario residents. In dismissing the application for leave, the Supreme Court recognized that each province is entitled to regulate within its own borders. See the Ontario Court of Appeal judgment
