Strada Crush Class Action Decertified

On January 27, 2020, the Superior Court of Justice decertified a class action brought by George Azar against Strada Crush Limited. This case involves a claim for unpaid wages by a group of employees. On July 23, 2019, the Court determined that Mr. Azar acted out of a personal interest rather than in the interest of the class, and that he was not a suitable representative plaintiff. Class counsel was given 60 days to find a new representative plaintiff. He did not do so. Instead, Mr. Azar moved to have himself re-appointed as representative Plaintiff. Strada Crush opposed the reappointment and sought to have the class action decertified, as nothing had changed to make Mr. Azar more suitable for the role. The Court agreed with Strada Crush, and decertified the class action. Rahool Agarwal and Vlad Calina represented Strada Crush in the motion. The decision can be found here: Azar v. Strada Crush Limited, 2020 ONSC 549.
