Jonathan Lisus and James Renihan uphold decision in the Ontario Court of Appeal approving the Hudson Bay/RioCan deal structure.
On February 10, 2016, the Ontario Court of Appeal upheld the decision of the Superior Court of Justice allowing the Hudson’s Bay Company to assign its leases in Yorkdale Shopping Centre, Scarborough Town Centre and Square One Mississauga without OMERS Realty Corporation’s consent for the purpose of facilitating a joint venture between Hudson’s Bay and RioCan.
