LOLG SUCCESSFULLY OBTAINS MANDATORY INJUNCTION

On March 19, 2021, the Ontario Superior Court of Justice released its decision granting a mandatory injunction against purchasers to provide vacant possession of a condominium townhouse. In granting this extraordinary remedy, the decision reaffirms the role of courts in protecting property rights and that, in the case of trespass, a property owner is presumptively entitled to an injunction. In representing the vendor, Michael Currie and Fabian Suárez-Amaya sought and obtained this relief in an expedited proceeding of less than three months.
