LOLG Succeeds at Divisional Court

Michael Currie represented a home builder in successfully dismissing a motion to set aside an order under 21(5) of the Courts of Justice Act. The decision reaffirms the high bar for a party to succeed in setting aside an order of the Divisional Court. It also reaffirms that parties should look closely at the legislation that formed the first instance decision, including whether it precludes appeals. The Court awarded the home builder its costs for the motion.
