Court Orders Plaintiff to Fund Defence Costs

In a recent decision, James Renihan successfully obtained an order requiring the plaintiff to indemnify his client, a former director and officer, for legal expenses incurred in defending the action. While the plaintiff drafted the claim in an effort to avoid the obligation to indemnify directors and officers, the Court found that the issues in the case inevitably engaged matters pertaining to the work of the company’s directors and officers.
