Acting for the appellant before the Ontario Court of Appeal, Jonathan Lisus and Philip Underwood successfully established that Ontario’s Regulated Health Professions Act does not prohibit the online sale in Ontario of prescription eyewear by a British Columbia company. The Court of Appeal adopted the appellant’s argument that the connection between its sales of prescription eyewear and Ontario was constitutionally insufficient to support the application of the Ontario regulatory scheme to lawful activities occurring in and regulated under British Columbia law.
