On November 20 and 21, 2018, Jonathan Lisus and Larissa Moscu appeared in the Court of Appeal for Ontario on behalf of their pro bono client, the Canadian Civil Liberties Association, on an appeal challenging the constitutionality of the federal legislation that permits inmates to be imprisoned indefinitely in solitary confinement. Jonathan and Larissa, together with a team from McCarthy Tetrault, initially appeared on behalf of the CCLA before Associate Chief Justice Marrocco on the trial of this case and, although they were successful in persuading His Honour to strike down the federal legislation, the CCLA nonetheless appealed in an attempt to secure an even more favourable result.
