Counsel to the moving parties, a group of property development companies, in a motion to vary terms of a Mareva Order to remove all restraints against various assets owned by the companies. The Mareva was brought against John Aquino by Ernst & Young Inc., in its capacity as court-appointed monitor of Bondfield Construction Company Limited. The corporate entities sought to vary the Mareva on the basis that Mr. Aquino had no ongoing ownership interest over certain assets subject to the Order. LOLG was successful in varying the terms of the Mareva Order on consent, prior to the return of the motion.
